1. Introduction
BuildNIX operates an online freelancing and marketplace platform that connects clients with freelancers and vendors offering digital services and products. We collect and process personal information to operate the platform, facilitate transactions between users, secure the Service, and comply with our legal obligations. This policy explains those practices in plain terms and tells you how to exercise the choices and rights available to you.
2. Scope of This Policy
This Privacy Policy applies to personal information we collect through the Websites, the Service, and our communications with you. It does not apply to information collected by third parties whose websites or services may be linked from the Websites or whose products and services are integrated with the Service, such as Stripe. Those third parties have their own privacy practices, which we encourage you to review.
Where you act on behalf of an organization (a "Subscribing Entity"), you represent that you are authorized to share that organization's information with us in accordance with this policy and any agreement between us.
3. Information You Provide to Us
We collect information that you provide directly when you create an account, complete a vendor application, post or fulfill a project, message another user, or contact us. This information may include:
- Account information: your name, email address, password, profile photo, and account type (client, freelancer, or vendor).
- Vendor application information: the categories you sell in, whether you sell services and/or digital products, your portfolio links, biographical information about your work, and any supporting materials you choose to share.
- Listing and project information: titles, descriptions, pricing tiers, delivery windows, revision policies, images, and downloadable assets you upload to the Service.
- Order and communication content: messages, attachments, delivery notes, revision requests, and dispute reasons you submit through the platform.
- Reviews and ratings: the star ratings and comments you leave after an order is completed.
- Support and correspondence: the contents of any email, ticket, or other correspondence you send to BuildNIX, and any information you choose to share with our support team.
4. Information We Collect Automatically
When you use the Websites or the Service, we and our service providers automatically collect certain information about your device and how you interact with us. This may include:
- IP address, approximate location derived from IP, browser type and version, operating system, device identifiers, and language preferences.
- Pages and listings you view, links you click, search queries you submit, and timestamps for those events.
- Session identifiers, referring URLs, and information about how you arrived at the Websites.
- Error reports and performance data we use to maintain the reliability of the Service.
We use this information to operate, secure, and improve the Service, to detect and prevent abuse, and to generate aggregated, non-identifying analytics about how the platform is used.

- To facilitate transactions between clients and freelancers or vendors, including order creation, delivery, escrow, revisions, disputes, and payouts.
- To enable communication between users through the platform's messaging system and to deliver service notifications by email or in-app.
- To display public profiles, listings, ratings, and reviews to other users and visitors.
- To prevent fraud, protect against abuse, enforce our Terms of Service, and meet legal and regulatory obligations.
- To respond to your support requests, questions, and feedback.
- To improve the Service, troubleshoot issues, and develop new features.
- To send transactional emails (such as receipts, order updates, and security alerts) and, where permitted, service-related announcements. You can unsubscribe from non-essential emails at any time.
7. Legal Bases for Processing
Where required by law, we rely on one or more of the following legal bases to process your personal information:
- Performance of a contract: to provide the Service to you under our Terms of Service.
- Legitimate interests: to operate, secure, and improve the Service, prevent fraud, and communicate with users.

9. Payments and Stripe Connect
Payments on BuildNIX are processed by Stripe, Inc. through Stripe Connect. When you make or receive a payment, information such as your name, email, payment method details, bank or card information, business details (for vendors), and transaction history is collected and processed directly by Stripe in accordance with Stripe's privacy policy.
BuildNIX does not store full payment card numbers on our servers. We receive and retain transaction-level metadata such as order amounts, fees, payouts, transfer identifiers, refund identifiers, and payment status so we can operate the platform, reconcile escrow, support disputes, and meet our accounting and tax obligations.
Vendors who onboard with Stripe Connect agree to Stripe's Connected Account Agreement and authorize Stripe to share certain account information with BuildNIX so we can verify that payouts can be safely released. We use that information only to operate the Service.
10. Communications Between Users
Messages, files, delivery notes, revision requests, and dispute submissions exchanged through the Service are stored on our systems to support the order, facilitate dispute resolution, and meet our legal obligations. Staff may review communications in limited circumstances, such as when investigating a dispute, abuse report, or potential violation of our Terms of Service.
Do not share information through the platform that you do not want stored or potentially reviewed by BuildNIX staff for these purposes.
11. Public Profiles and Listings
Your public profile, listings, ratings, and reviews are visible to other users and visitors of the Websites by design. You control what you choose to publish. If you remove a listing or profile element, copies may remain in cached versions, archives, search engine indexes, or screenshots beyond our control.
12. Data Retention
We retain personal information for as long as your account is active and for the period required to provide the Service, comply with our legal obligations, resolve disputes, enforce our agreements, and maintain accurate accounting and tax records. Transaction records associated with completed, refunded, or disputed orders are typically retained for the period required by applicable financial and tax laws.
After a retention period ends, we either delete the information or de-identify it so it can no longer be associated with you.
13. Data Security
We use technical and organizational safeguards to protect personal information from unauthorized access, disclosure, alteration, and destruction. These include encrypted connections to the Websites, hashed password storage, access controls, logging, and routine review of our security practices.
No system is completely secure. We cannot guarantee that unauthorized access or loss will never occur, and you use the Service at your own risk. You are responsible for protecting your account credentials, using a strong password, and signing out of shared devices.
14. Your Rights and Choices
Subject to applicable law, you have the following choices and rights regarding your personal information:
- Access and correction. You can view and update most of your profile information from within your account settings. If you cannot update something yourself, contact us.
- Deletion. You can request deletion of your account and associated personal information. We may retain certain information as required by law (for example, financial records) or to resolve outstanding disputes.
- Marketing communications. You can opt out of non-essential marketing emails by using the unsubscribe link in those messages. We will still send transactional and security-related messages required to operate your account.
- Cookies. You can manage cookies through your browser. See Section 5 for details.
- Complaints. If you have a concern about how we handle your information, please contact us. You may also have the right to lodge a complaint with a supervisory authority in your jurisdiction.
15. Notice for California Residents
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, provides you with additional rights regarding your personal information, including the right to know what categories of personal information we collect, to request access to and deletion of that information, to opt out of any "sale" or "sharing" of personal information, and not to be discriminated against for exercising your rights.
BuildNIX does not sell personal information for money. To exercise your CCPA rights, contact us using the details in Section 22. We will verify your request before responding and may require additional information to confirm your identity.
16. Notice for EU and UK Residents
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights of access, rectification, erasure, restriction, objection, and portability with respect to your personal information, as well as the right to withdraw consent where processing is based on consent. The legal bases on which we rely are described in Section 7.
BuildNIX acts as a data controller for personal information collected through the Service. Some of our service providers may be located outside the EEA, the UK, or Switzerland. When we transfer personal information to those locations, we rely on lawful transfer mechanisms such as standard contractual clauses where required.
17. Children's Privacy
The Service is not directed to, and not intended for, children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a child under 18, please contact us so we can take appropriate action to delete it.
18. International Data Transfers
BuildNIX is based in the United States. When you use the Service from outside the United States, the personal information you provide will be transferred to, processed in, and stored in the United States and other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your home country. By using the Service, you consent to the transfer and processing of your information in those jurisdictions, subject to the safeguards described in this policy and applicable law.
19. Third-Party Services and Links
The Websites may contain links to third-party websites, products, or services, including but not limited to Stripe, third-party content providers, and outbound links posted by users. BuildNIX is not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before sharing personal information with them.
20. Do Not Track Signals
Some browsers transmit "do not track" signals. Because the technology industry has not adopted a uniform standard for how such signals should be interpreted, the Service does not currently respond to "do not track" signals. We will update this policy if industry standards change.
21. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page and, where the changes are material, provide additional notice through the Service or by email. Your continued use of the Websites or the Service after the effective date constitutes your acceptance of the revised policy.
